These Terms of Service ("Terms") govern your access to and use of the EmailBot KH application available at emailbot.approfits.com (the "Service"), operated by EmailBot KH ("we", "us", "our"). By using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using EmailBot KH, you confirm that you are at least 18 years old and have the authority to enter into these Terms. If you do not agree, you may not use the Service.

2. Service Description

EmailBot KH provides email marketing, automation, and outreach tools. Features include campaign creation, contact management, email sequencing, analytics, and optional integration with third-party services such as Google Gmail.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.

3. Google API Services — Gmail Integration

If you choose to connect your Google account, you authorize EmailBot KH to access your Gmail data via Google's APIs under the following scopes:

• gmail.send — send emails on your behalf.
• gmail.modify — organize and label messages.
• gmail.readonly — read replies to match them to your campaigns.
• userinfo.email & userinfo.profile — identify your account.

Your use of Gmail data through EmailBot KH is also subject to the Google API Services User Data Policy. We comply with the Limited Use requirements: we do not use Gmail data to train AI/ML models, serve advertising, or for any purpose other than providing the user-facing features you have enabled.

You may revoke EmailBot KH's access to your Google data at any time via Google Account Permissions.

4. User Accounts & Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use.

5. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited bulk email, or harassing messages.
• Violate any applicable laws or regulations, including anti-spam laws (e.g., CAN-SPAM, GDPR).
• Impersonate any person or entity, or falsely state your affiliation.
• Distribute malware, viruses, or other harmful content.
• Scrape, crawl, or harvest data from the Service without authorization.

We may suspend or terminate your account for violations of this policy.

6. Payment, Subscriptions & Refunds

Some features require a paid subscription. Plan prices are published on our Pricing page and are quoted in US Dollars (USD). Payments are accepted through ABA PayWay (card and ABA Pay) and KHQR; transactions may be settled in USD or KHR at the rate applied by the acquiring bank. The amount charged is always calculated server-side and shown to you before you confirm payment.

Subscriptions are billed in advance on a recurring monthly basis and renew automatically until cancelled. Access to paid features is activated immediately after a payment is confirmed, and a receipt is emailed to you and stored under Billing → Receipts. You may cancel at any time from Billing → Subscription; access continues until the end of the current billing period.

Refunds are governed by our Refund & Cancellation Policy, which includes a 7-day satisfaction window for first-time purchases and full refunds for duplicate charges, unauthorized transactions, and non-delivery of service. Approved refunds are returned to the original payment method.

EmailBot KH does not collect or store full card numbers, CVV codes, or bank credentials; all payment data is handled by ABA Bank and the KHQR network.

7. Intellectual Property

EmailBot KH and its original content, features, and functionality are owned by us and protected by international copyright, trademark, and other laws. You may not copy, modify, or create derivative works without our express permission.

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information, including Google user data.

9. Limitation of Liability

To the maximum extent permitted by law, EmailBot KH and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data loss, arising out of or relating to your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless EmailBot KH, its affiliates, and their respective officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Kingdom of Cambodia, without regard to conflict-of-law principles. Disputes that cannot be resolved amicably shall be submitted to the competent courts of Phnom Penh, Cambodia.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on this page with an updated date. Continued use of the Service after changes constitutes acceptance.
